Perlindungan Hak Kepemilikan Atas Tanah Pascabencana Longsor dan Banjir Sumatera Tahun 2025 Berdasarkan Undang-Undang Nomor 5 Tahun 1960

The landslide and flood disasters in Sumatra in 2025 not only caused material losses but also created legal uncertainty regarding land ownership rights for affected communities. From an agrarian law perspective, this condition can be categorized as force majeure, potentially leading to land destruction. This study aims to analyze legal protection for post-disaster land rights holders based on Law Number 5 of 1960 concerning Basic Agrarian Regulations (UUPA), state responsibility, and obstacles to its implementation. The study used a normative juridical method with a statutory and conceptual approach, through a qualitative analysis of primary, secondary, and tertiary legal materials. The results show that post-disaster legal protection is not optimal because the UUPA does not specifically regulate the mechanism for restoring land rights due to disasters. Determining the status of destroyed land still requires legal certainty, while state responsibility focuses more on emergency response and land administration. The main obstacles include difficulties in reconstructing land boundaries and weak regulatory synchronization. Therefore, land law reform is needed through special regulations that guarantee the protection of civil rights for disaster-affected communities.
