Abstract

The development of digital communication has created new challenges in criminal law enforcement, particularly in determining the legal qualification of threats conveyed through social media. This study aims to analyze the dissenting opinion in Supreme Court Decision Number 65 K/Pid/2026, the legal construction of Article 335 of the Indonesian Criminal Code and Article 27A in conjunction with Article 45 paragraph (4) of the Electronic Information and Transactions Law, and the legal capacity of judges in interpreting electronic-based criminal acts. This research uses normative legal research with a qualitative approach by examining statutory regulations, and court decisions. The research show that the dissenting opinion arose from different interpretations of the elements of “threat” and “coercion” in Article 335 of the Criminal Code. The study also finds that the defendant’s conduct was more appropriately constructed as a criminal threat under Article 335 rather than as an offense under Article 27A of the Electronic Information and Transactions Law. This study implies the need for clearer legal boundaries between conventional criminal law and cyber law to strengthen legal certainty in digital criminal cases.
