Perceraian Umat Katolik dalam Perspektif Hukum Positif dan Hukum Gereja Katolik di Desa Adat Tuka

This research examines the juridical aspects of divorce among Catholic communities in Tuka Traditional Village, North Kuta District, Badung Regency, viewed from the perspective of positive law and Canon Law. The study is grounded in the existence of legal dualism, where Indonesian positive law permits divorce, while the Catholic Church maintains the principle of the indissolubility of marriage. The objective of this research is to analyze how both legal systems are applied and to identify the legal and social implications arising from such conditions. This study employs an empirical legal method with conceptual and sociological approaches. Data were obtained through literature review and field research. The findings indicate that although divorce is legally recognized through court decisions, the Catholic Church continues to uphold the permanence of marriage as a sacred bond. This situation creates legal uncertainty as well as social and spiritual dilemmas for Catholic individuals. Therefore, there is a need to harmonize state law, religious law, and customary law to ensure legal certainty and justice in society.
